SPECD Terms of Service
Effective date: July 27, 2026
These Terms of Service ("Terms") are a binding agreement between you and DAILY DRIVE LLC, doing business as SPECD ("SPECD," "we," "us," or "our"), the operator of https://specd.studio and related applications and services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, our Automotive Disclaimer, and any additional terms that apply to specific features (for example, Event & Competition Rules and the Refund & Billing Policy). If you do not agree, do not use the Service.
Please read Sections 12 (Disclaimers), 13 (Limitation of Liability), and 15 (Dispute Resolution; Arbitration; Class-Action Waiver) carefully — they limit our liability and affect how disputes are resolved.
1. What SPECD is (and is not)
SPECD is a planning, estimation, and organization tool and community platform for vehicle enthusiasts, garages/shops, and automotive brands. Depending on your account, the Service may let you:
- build and save vehicle "build sheets" (parts, estimated costs, payment/build timelines, phases);
- browse a catalog of parts and options and add them to a build;
- receive or submit bids/quotes between vehicle owners and independent shops;
- discover and RSVP to car meets and events; enter builds into brackets/ tournaments; vote on matchups; and appear on rankings/leaderboards;
- upload photos and other content; and
- communicate with other users, shops, or brands.
SPECD is not a mechanic, tuner, engineer, installer, dealer, distributor, insurer, safety inspector, emissions/regulatory authority, financial advisor, escrow service, or sanctioning body. We do not perform work on vehicles, verify that any part fits or is safe or legal, guarantee any estimate, or supervise any shop, event, or transaction. Information in the Service — including part compatibility, prices, specifications, horsepower/torque figures, labor estimates, and timelines — is informational only, may be inaccurate or out of date, and must be independently verified. See Section 12 and the Automotive Disclaimer.
2. Eligibility and accounts
- Age. You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and you may not make purchases or enter events except as permitted by these Terms and applicable event rules. Certain features (e.g., paid features, purchases, or in-person events) may require you to be 18+. The Service is not directed to children under 13, and we do not knowingly collect their information (see Privacy Policy).
- Account types. Accounts may be designated as user, shop/garage, admin, or other roles. Certain roles require an access code or approval and may be subject to additional terms. We may grant, deny, change, suspend, or revoke roles at our discretion.
- Registration. You agree to provide accurate information, keep it current, and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use at lancefenderson@specd.studio.
- One person per account unless we expressly allow shared/organization accounts. You may not share, sell, or transfer your account.
3. Third parties: shops, brands, vendors, and other users
The Service connects independent third parties, including vehicle owners, garages/shops, aftermarket brands, event hosts, and other users. These parties are not employed, controlled, endorsed, or supervised by SPECD, and their listings, quotes, bids, reviews, work, parts, and communications are their own.
- SPECD does not guarantee the quality, safety, legality, pricing, availability, timeliness, or outcome of any product, service, quote, bid, installation, or transaction between you and a third party.
- Any contract, payment, or dispute for work or products is **between you and the third party.** We are not a party to it and are not responsible for it. You should independently vet any shop or vendor (licensing, insurance, reviews, references) before hiring or buying.
- Ratings, reviews, votes, and rankings reflect user- and system-generated inputs and are not SPECD's endorsement or a guarantee of any provider.
4. Build sheets, parts, prices, and estimates
- Build sheets, part data, options, prices, specs, performance figures, and labor or timeline estimates are provided for planning and informational purposes and may be incomplete, inaccurate, outdated, or wrong.
- SPECD does not guarantee that any part fits your vehicle; that a build is road-legal, track-legal, emissions-compliant, or safe; that a build will not void a manufacturer or aftermarket warranty; or that any estimate reflects actual cost, labor, or lead time.
- You are solely responsible for verifying fitment, installation requirements, safety, legality (including local, state, federal, and emissions law), warranty impact, and event/rule compliance with the manufacturer, installer, or relevant authority before you purchase, install, drive, or compete. See the Automotive Disclaimer.
5. User content
"User Content" means anything you submit, upload, or post — including vehicle info, build sheets, photos, comments, reviews, messages, and event entries.
- Ownership. You keep the rights you have in your User Content.
- License to SPECD. You grant SPECD a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (e.g., resize/format), display, distribute, and otherwise use your User Content to operate, provide, improve, and promote the Service. This license ends when you delete the content, except (a) for content others have re-shared or saved, (b) for reasonable backup/retention periods, and (c) for aggregated or de-identified data.
- Your promises. You represent that you own or have all necessary rights to your User Content and its use on the Service, and that it does not violate the law or anyone's rights. You may only upload photos, logos, videos, or other material you own or have permission to use. See the Acceptable Use Policy and Copyright & DMCA Policy.
- Reviews, votes, and rankings must be honest. Do not post fake reviews, fake testimonials, or manipulated votes; do not review your own business or a competitor's deceptively; do not offer or accept incentives for reviews without disclosure. We may remove content that violates this.
- No obligation to monitor; right to moderate. We are not obligated to monitor User Content but may review, remove, restrict, or refuse any content or account, at any time, with or without notice, in our discretion.
6. Acceptable use
You agree not to misuse the Service. Prohibited conduct is described in the Acceptable Use Policy, which is part of these Terms and includes (without limitation) illegal activity, infringement, harassment, fraud, scraping, reverse engineering, security attacks, spam, and misrepresenting affiliations or endorsements.
7. SPECD credits, virtual items, purchases, and payments
- The Service may include SPECD credits, competition-entry credits, or other virtual items ("Virtual Items"). Virtual Items have no cash value, are not money, currency, stored value, or a financial instrument, are not redeemable for cash, and are non-transferable except as we expressly allow. We may create, modify, revoke, or discontinue Virtual Items at any time.
- Any paid features, subscriptions, or transactions are governed by the Refund & Billing Policy and any terms shown at purchase, which are incorporated here. Payments may be processed by a third-party processor (e.g., Stripe); we do not store full payment card numbers.
- SPECD does not hold funds for vehicle work as an escrow or money transmitter. Do not use the Service to move funds in a way that we do not expressly support.
8. Events, meets, brackets, voting, and prizes
Participation in car meets, competitions, brackets, voting, rankings, and prizes is subject to the Event & Competition Rules, which are part of these Terms. In-person events involve risk; waivers, releases, and additional rules apply. Nothing on the Service is a lottery or gambling offering; do not treat it as one.
9. Intellectual property (SPECD's)
The Service, including its software, design, logos, "SPECD" name and branding, text, and other materials (excluding User Content and third-party content), is owned by SPECD or its licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not copy, modify, distribute, sell, frame, scrape, or create derivative works from the Service except as expressly allowed.
10. Feedback
If you send us ideas or feedback, you grant us an unrestricted, royalty-free right to use them without obligation to you.
11. Third-party services and links
The Service integrates or links to third-party services (for example, sign-in providers, maps, hosting, notifications, and payment processors). We do not control and are not responsible for third-party services, and your use of them may be governed by their own terms and privacy policies.
12. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, SPECD disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage.
Without limiting the above, SPECD specifically makes no warranty or guarantee that: (a) any part is compatible with, or safe or legal for, any vehicle or use; (b) any build, modification, or plan is road-legal, track-legal, emissions- compliant, safe, or warranty-safe; (c) any price, spec, performance figure, labor estimate, or timeline is accurate; (d) any shop, vendor, brand, or user is qualified, licensed, insured, or reliable; (e) the Service will be uninterrupted, secure, or error-free; or (f) any result, ranking, vote, or event outcome is accurate or free from error.
You assume all risk arising from your reliance on the Service and from any purchase, installation, modification, driving, competition, or transaction. Always verify with the manufacturer, a qualified professional installer, and the relevant legal/sanctioning authority before acting.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- SPECD and its owners, officers, employees, and agents **will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages**, or for lost profits, revenue, data, goodwill, or for personal injury, property damage, vehicle damage, or death, arising out of or relating to the Service, your builds or modifications, any third party (including any shop, vendor, brand, or event), or these Terms — even if advised of the possibility.
- SPECD's total aggregate liability for all claims relating to the Service will not exceed the greater of **(a) the amount you paid SPECD in the twelve (12) months before the event giving rise to the claim, or (b) US $100.**
These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless SPECD and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any law or third-party right; (d) any build, modification, purchase, installation, driving, or event participation by you; or (e) any dispute between you and a third party (including any shop, vendor, brand, or user).
15. Dispute resolution; arbitration; class-action waiver
- Informal resolution first. Before filing anything, contact us at lancefenderson@specd.studio and give us 30 days to try to resolve the dispute.
- Binding arbitration. Except for the exceptions below, any dispute relating to the Service or these Terms will be resolved by **final and binding individual arbitration**, not in court, administered by a recognized arbitration provider under its consumer rules, seated in North Carolina.
- Class-action waiver. You and SPECD agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
- Exceptions. Either party may (a) bring an individual claim in small-claims court, and (b) seek injunctive relief in court for intellectual-property or unauthorized-access matters.
- Opt-out. You may opt out of arbitration by emailing lancefenderson@specd.studio within 30 days of first accepting these Terms, stating your name and intent to opt out.
If the arbitration/class-waiver provisions are found unenforceable, disputes will be resolved in the state or federal courts located in North Carolina, and you consent to their jurisdiction and venue.
16. Governing law
These Terms are governed by the laws of the State of North Carolina and applicable U.S. federal law, without regard to conflict-of-laws rules.
17. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive (e.g., 3, 4, 5 (license), 7, 9, 12–16, 18–20) survive termination.
18. Changes to the Service and to these Terms
We may modify or discontinue the Service (or any feature) at any time. We may update these Terms; if we make material changes, we will provide reasonable notice (e.g., by posting the updated Terms with a new effective date or by email). Continued use after changes take effect means you accept the updated Terms.
19. Miscellaneous
- Entire agreement. These Terms and the documents referenced here are the entire agreement between you and SPECD regarding the Service.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms; we may assign them (e.g., in a merger or sale).
- No agency. No partnership, agency, or employment relationship is created.
