SPECD Copyright & DMCA Policy

SPECD respects intellectual-property rights and expects users to do the same. Users may only upload content they own or have permission to use (see the Acceptable Use Policy). We respond to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA").

1. Designated DMCA agent

Send copyright notices to our Designated Agent:

Register this same agent with the U.S. Copyright Office's DMCA Designated Agent Directory before relying on the safe harbor.

2. How to submit a takedown notice

To report content you believe infringes your copyright, send the Designated Agent a written notice that includes:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you claim was infringed;
  3. identification of the material you claim is infringing and enough information for us to locate it (e.g., a URL or clear description);
  4. your contact information (name, address, phone, email);
  5. a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may delay processing. Knowingly making a material misrepresentation in a notice can result in liability.

3. Our response

Upon receiving a valid notice, we will remove or disable access to the identified material, notify the user who posted it where appropriate, and, in appropriate cases, track the incident under our repeat-infringer policy.

4. Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send the Designated Agent a counter-notice that includes:

  1. your physical or electronic signature;
  2. identification of the material removed and its former location;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
  4. your name, address, and phone number; and
  5. a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., for North Carolina), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we may restore the content in 10–14 business days unless the original complainant notifies us they've filed a court action.

5. Repeat infringers

We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users who are repeat infringers.
